One important trait that a good agent needs is a spine. I cant stand when my agents say the other agent or a customer is putting pressure on them.

I say do not let anybody put pressure on you, you out pressure on them.

Do not let anybody make demands on you, you make demands on them.

You have to take control of the situation.

You have to be able to say NO!

We had an offer that was gobbly gook. The Buyer’s name was entered where the Seller’s name should be. The Seller’s name was entered where the Buyer’s name should be.

There where cross outs EVERYWHERE. I could not tell what the price being offered was.

And the agent refused to clean it up and wanted a response, on Sunday at 9:00 at night!!!

I told my agent to tell the Buyer’s agent that the offer was rejected and to come back with a clean offer.

Ep. 141 - Real Estate Teams & Advertising: What You Can’t Say in Your Team Branding

In Florida, real estate teams or groups must adhere to specific advertising regulations outlined in Florida Administrative Code Rule 61J2-10.026. Key requirements include:

• Brokerage Supervision: All team members must operate under the supervision of the same registered broker or brokerage.

• Designation of Responsibility: Each team must appoint a designated licensee responsible for ensuring the team's advertising complies with Chapter 475 of the Florida Statutes and Division 61J2 of the Florida Administrative Code.

• Monthly Member Records: The registered broker is required to maintain an up-to-date written record of all team members, updated at least monthly.

• Naming Restrictions: Team names may include "team" or "group" but must not contain terms that suggest the team is a separate real estate brokerage or company, such as:

• Agency
• Associates
• Brokerage
• Brokers
• Company
• Corporation
• Corp.
• Inc.
• LLC
• LP, LLP, or Partnership
• Properties
• Property
• Real Estate
• Realty

This is to prevent any implication that the team operates independently of the brokerage.

• Advertising Display: In all advertisements, the team name must not appear in larger print than the name or logo of the registered brokerage. This ensures that the brokerage's identity is prominent and clear to the public.

These rules are designed to maintain transparency and prevent consumer confusion regarding the relationship between real estate teams and their supervising brokerages.

Ep. 136 - The Walk Through Before Closing

Recently at the walk through before a closing for one of Jill Glanzer’s Buyers, we discovered that the Seller failed to deliver the property in the condition that was agreed to in the contract and inspection addendum.

The contract was supposed to include all television sets, and according the the inspection report the Seller was supposed to replace all of the light bulbs that where out. Usually not a big deal, but when the ceiling is 20 feet tall, changing a lightbulb is not as simple as changing a lightbulb.

While not required by law, a Seller’s Disclosure is a good way for a Seller (and a Seller’s agent) to cover their ass. Buyer’s agents should always ask for one in any offer they draft on behalf of their Buyers. Listing agents should ask their Sellers to fill one out after they sign the listing agreement, while they are waiting for photos and preparing the listing for the MLS. The biggest complaint that I hear about real estate agents from their customers is that the real estate agent has not been in touch with the customer for an extended period of time. It is very important to follow up with your sellers, buyers and leads. Do not let too much time pass without contacting them. If you show one of your listings, understand that the seller got the house ready, and vacated to accommodate you. You MUST let the seller know if you are finished and if there is any feedback. You must follow up with the showing agent and see if they want another look. If you have a buyer, stay in touch. Offer to show houses. Check in. Because if you don’t, someone else will. Ep. 130 - Offers of Compensation Can Be Advertised Anywhere EXCEPT the MLS

According to the new rules that went into effect August 17, 2024 you may not display any form of compensation in the Multiple Listing Service. This includes a Bonus. You may however advertise it ANYWHERE ELSE. Sky writing. A billboard. A tattoo that says Bonus! It’s an easy rule. Just ask yourself: is this the MLS? If it’s Facebook, or a television ad, the answer is clearly No. Similarly, according to the new rules a real estate agent may not show a house to a customer without a written agreement that specifies how much the real estate agent will be paid. Can a listing agent show a potential buyer his or her listing? Sure. Because that Buyer is not a customer. If that Buyer becomes a customer, they need a written agreement. It’s an easy rule. Ep. 128 - As Is with the Right to Re-Inspect with Preston Smith

When a Buyer and Seller enter into the Florida As-Is Contract many times they have a different view of that As-Is means. Buyer’s often believe they can ask for credits and/or repairs during the inspection period. Seller’s often believe they are selling the house As-Is and they do not have to make any repairs. Often when a Seller negotiates they will agree to a price but want to let the Buyer know they will not negotiate anything during the inspection period. Sometimes this is a declaration from the Seller, and it is not an agreed upon term by the Buyer. The truth is the Buyer’s only remedy is to cancel the contract during the inspection period if they are not satisfied. Buyer’s will use the threat of cancelling to get a credit or repair or some other term they desire. The fault in any advance agreement to “Not Negotiate any repairs, is that often times the inspection reveals something the Buyer did not know when they went to contract. If the Buyer would never have agreed to the price when they went to contract, it is unreasonable to expect the Buyer to simply ignore this issue. A reasonable Seller would have to consider this new information. How an agent handles these situations is what separates a good agent from a bad agent and a great agent. Ep. 125 - Baiting The Hook

This has been on my mind for a while now. When you are marketing a property there are so many things you want to say, so many features you want to point out. The problem is, How do you start?’ In the initial ads, you are trying to drive traffic to the house, you can’t point out all the individual features when you are baiting the hook and trying to get someone to see the house. Specific amenities do not always have to be pointed out in the first advertisements, to someone who may or not even interested in the house. Once they are at the house, then you can focus on specific features and upgrades. Setting the stage, trying to get people interested enough to see the house AND THEN show off the house and its features AND THEN why the house is better than other competing houses.

Ep. 122 - Decoupling Real Estate Commissions and listing an AMAZING property in Delray Beach, Florida

Welcome to The Real Estate Finder Podcast by Matthew H. Maschler, Real Estate Broker. Today in the Studio I am joined by Jill Glanzer and Preston Smith, of Signature Real Estate Finder. Traditionally the Seller of a home pays the commission for both the real estate agent who lists the house and the agent who helped the buyer. Decoupling means that instead of the Seller paying both agents, the Seller only pays the Listing Agent. Buyers have to negotiate and pay their own agent's fee. Take for example a $500,000 home: Scenario 1) the Listing Agent negotiates a traditional commission (say 6%) and from that amount pays the Buyer’s Agent (also called the Selling Agent or the Showing Agent). After the 6% commission is paid, The Seller nets $470,000. Scenario 2) If you decouple the commission and the Listing Agent only negotiates the listing fee, say 3%, the Buyer will ask in the offer that the Seller gives a 3% credit to the Buyer to pay the Buyer’s agent. The Seller still nets $470,000. Scenario 3) If the Seller refuses to pay the Buyer’s agent, the Buyer simply will offer 3% less for the home, and the Seller still nets $470,000. From the Seller to the Listing Agent’s brokerage firm. Ad then from the Listing Agent’s brokerage firm to the Buyer’s (also called Selling Agent) Agent’s brokerage firm. Many times the Closing Agent will split it on the closing statement for every once’s convenience so it only LOOKS like the Seller has been paying the Buyer’s Agent (Selling Agent), but in reality that has NEVER been the case. Ep. 120 - Are we Real Estate Agents or Stand Up Comedians?

On today’s Real Estate Finder Podcast, Matthew reveals that since the last time Staci was in the studio, she performed stand up comedy at the Sadman Comedy Cafe right here in Royal Palm Plaza in Boca Raton, FL.

According to Staci, it was “a one and done life bucket list item,” but that remains to be seen. One great idea is to have an open mike real estate ”industry” night where real estate agents could say their pet peeves, worst things to ever happen and dish the hilarious dirt on what goes on behind the front doors in the professional world of real estate.

You probably think it never happens, but believe it or not selling the same property more than once or twice actually does happen. Loyal customers are usually the reason. Staci’s on her 4th transaction on the same property and it’s a corporate relocation, which we will talk more about later in the deal.

Tim’s vision for the Fund included not only providing scholarships but also the development of scholar support programs and services created to ensure the success of the scholars including pre-college physicals, laptops for each scholar and a high school to college transition program.
Jay joined the George Snow Scholarship Fund as the Vice President of Development in January of 2023, after a successful showing at Boca’s Ballroom Battle. Previously, Jay was the Executive Director at St. Jude Catholic Church & School in Boca Raton. He oversaw all development, marketing and personnel for the church, as well as development for the school.

Prior to St. Jude, Jay worked at Lynn University as the Director of Major Gifts for 15 years.

Ep. 117 - Florida Panthers, Juneteenth Closings, MLS Status updates and Advertising Co-Operating Commissions

It is June and that means Father’s Day, Graduations and Juneteenth Celebrations. And you can not close on a house on June 19th! If I did not say it clearly enough, make sure you do not write a contract that calls for a closing on that day. And in 2027 when it falls on a Saturday, do not schedule a closing for the Friday before, when it will be observed on June 18th!

And how about those Florida Panthers? Up 3-1 in the Stanley Cup Finals when we recorded this. Go Cats!

Back to real estate please, we discuss updating the MLS once an offer is fully executed and becomes a binding contract. There is nothing worse than trying to show a house that shows Active in the MLS, only to be told it is under contract. What about bringing a Buyer for a back up when you know it is under contract? Find out!

Speaking of the MLS, in 2 months time, the MLS will no longer be able to display the incentive offered to a Buyer’s agent from the Listing agent for bringing the Buyer.

Ep. 110 - The Home Sale Contingency / Buying A New House When You Need to Sell Your Current One

Buying a new house when you need to sell your current one can be difficult. Do you sell yours first and show while you are living there? If you wait too long, panic can set in trying to find the new home. But can you afford the deposit and to close on the new home, if your current home has not sold?

A home sale contingency clause can be included in your offer to purchase that new home. With a home sale contingency, the transaction is contingent on the sale of the buyer’s home. If the house sells by the specified date, the contract moves forward. But if it doesn’t, the contract can be terminated. Sounds great right? But will the Seller accept such a provision? In a Seller’s market, probably not.

Why would a Seller give a Buyer the time and the opportunity to cancel the contract if the house they are selling to buy this house falls through?

In this episode, Matthew discusses under what circumstances he, as a Seller, would take such an offer. Because in the real world, this is a real issue that real people have to deal with.

Then we discuss the sticky situation Staci found herself in which may result in a new listing.

Ep. 109 - The Sky is Falling! NAR Settlement Eliminates Real Estate Commissions

No, the sky is not falling. On March 15, 2024 the National Association of Realtors (“NAR") settled a $5 Billion Buyer Broker Commission lawsuits brought by class action attorneys for $418 Million Dollars.

In this Episode we break it down. First we discuss how commissions work currently and who pays the commission.

Then we discuss the new rules. First that Buyer’s will negotiate commissions directly with their agents. Agents can not claim there is no cost to Buyers, unless they truly will not charge them. Seller’s can still pay the Buyer’s Agent. Buyer’s Agents will be required to sign agreements with Buyers setting forth what they will charge. It will need to be an amount can not be open ended (like whatever the seller offers). And the Multiple Listing Service can no longer display an offer of compensation to the Buyer’s Agent.

We talk about how these rules will work in the future, both in the short and long term.

And clarify that this lawsuit and settlement does not change anything about renters, the lawsuit had nothing to do with renters, but some or most of these practices will be put in place for tenants regardless.

Why did the NAR agree to this Settlement? Did they “sell us out” or did they have a VERY good reason? Tune in and find out!!!!

"Make sure you pay your taxes; otherwise you can get in a lot of trouble.” I did not write that title. It is a quote from President Richard Nixon. The other quote I was thinking of using for a title was by Albert Einstein "The Hardest Thing in the World to Understand is Income Tax.” That one is amusing because of course, Albert Einstein was a genius and if he thought it was hard to understand, what hope do the rest of us have?

Well there is hope. And her name is Jessica Green! Jessica is the managing director of Green Tax and Business Advisors.

In this working session, Siganture Real Estate Broker Matthew Maschler and and Staci Garcia continue to discuss the sale of a property to our mystery buyer. After the first Buyer disappeared and forfeited their deposit, the new Buyer (who we suspect is the same Buyer) put the house under contract. During inspection they asked to lower the price of the house, but they did not give any reason whatsoever. Just: Let’s get this done! We discuss the agent’s obligation to present all offers (she did), and we wonder if the Buyer still intends to buy the property (they do). In real estate, sometimes Sellers insist on a proof of funds, to even see the house. In real estate, many Sellers insist on seeing a proof of funds before they will even show you the house. The buyer doesn’t even know if they like the house and they’re not even ready to enter a negotiation. So as an agent or a seller, do you require proof of funds to do a first showing? We also discuss a mystery where, in the middle of the deal The Buyer disappeared. After inspections. They never applied to the HOA and the closing date has passed. How do you get the deposit back? What is FIRPTA? It is the withholding of a percentage of the sales price when the Seller is a non-Us person.

Why? So the IRS can get paid.

Matthew talks about some real estate deals he has done where this withholding is triggered.

FIRPTA: Sounds funny, but it won’t be funny if 15% is taken from the seller at closing.

The most common contract to buy a house in Florida is the “As Is” contract. But what does "As Is" mean?

And what should you look for during the inspection period?

When you have the home inspected, it is not a matter of Passing or Failing. You are provided the opportunity to get to know the property. How it works. What it is made of. It is the time to ask questions. To really decide if this is the house for you.

There is no point to getting the home inspected if you are not going to look at the inspection. And no one can do it for you. It is your money, your house, your duty to check it out. You don’t want to be surprised after the closing.

Can a real estate agent advertise another Broker’s listings? Absolutely, that is your job as an agent. To sell, and other Broker’s listing are your inventory.

But there are some pitfalls to be aware of. Sometimes you need permission. Sometimes you do not. And you always need to credit the Listing Broker.

Also, what happens when a Buyer calls you directly and does not want a commission? In Florida, as a real estate agent this is a cause for celebration. But many Buyers do not understand how the listing agent is paid in this situation.

Ep. 91 - Who is the title agent? Can the contract be assigned? And restrictions on Foreign Nationals buying Florida property.

You might be surprised to hear that there is no Title Agent in a contract. There is an Escrow Agent and there is Closing Agent. These can be the same person or company, or they can be two different people or companies. A title company can do either role, but so can other entities.

The “Escrow Agent" holds the deposit. It can be a Real Estate Brokerage Firm. Lawyer or Law Firm, a Title Agency, or other person or business.

The Buyer specifies the escrow agent in the offer, and the Seller can agree or negotiate for a different one.

The “Closing Agent” does the paperwork to transfer the deed, disburse funds and do the title work. It can be a lawyer, Law Firm or a Title Agency.

The contract is SILENT on who the Closing Agent is going to be, it merely says who CHOOSES the Closing Agent and who PAYS for the Owner’s policy (The Buyer will be the Owner of the house after the closing).

We also tackle two other issues in the contract that I think needs to be explained.

The assignability provision of the contract. Can the Buyer assign the contract to another Buyer. Most Buyer agents say No in the offer. I say Yes, as long as the Buyer is not relieved of liability. This seems fair to both parties. Why would a Seller object? Tune in and I will Mattsplain.

Finally, we tackle the new law in Florida that prohibits Buyers from Syria, China, Cuba, Iran, Russia, Venezuela and North Korea. Can this be legal?

I’d like to make them “feel the pain” as one of my favorite clients likes to say. Especially in this situation because these rental clients knew I have a child with cancer and I was extremely tight for time. I was definitely making a special effort for them and they knew it.

It is a reminder to all the real estate agents out there that when dealing with the other party, it is important to remember that it is not your deal. It is not your decision. Do not insert yourself. Let’s say you represent the seller, if the buyers agent says that their customer wants a credit, you MUST ask the seller. Do not just give the answer that you think the Seller would say. Ask the seller. You can advise the Seller, you can phrase it in a way that shows the Seller you understand his or her stance, but you must ask. Wow. Ep. 86 - Short Term Rentals

How do I handle telling the customer that there are no one month rentals in Boca Raton? I remember renting houses on the Jersey shore for one week at a time. They were handled by the local real estate agents. But not anymore of those deals are handled by Airbnb or VRBO. For me, anything under six months just is not realistic to find a rental, but I guess it could be a short as three months. Under 3 months it’s just not what we as Realtors do. Many people think Boca Raton, and or Palm Beach County, is the resort community like the Jersey shore, or Galveston or Gatlinburg. But South Florida is more of a residential community and we just don’t have the inventory of short term rentals. So if you’re an agent and a customer wants a three week or two month rental I think it’s OK to just tell the customer I’m sorry that is not what we do. If you are looking for a seasonal or annual rental, please give me for my team call and we would be happy to help you as best as we can. Personally, I love doing rentals. There is a certain amount of “mystery" surrounding what services are actually performed to prepare for a closing. Greg walks us through the contract, from executed offer to a successful closing.

Some of the most common mistakes seen by Greg are real estate agents using the terminology “On or before” for the closing date. This comes from other states and is not a term used in Florida.

In Florida Buyers and Sellers do not need an attorney to read the contract, but it is a good idea to have an attorney available for the title process because no two deals are ever the same.

In addition, we discuss “Investor" programs in mandatory membership country clubs. These are programs that allow investors and builders to buy and renovate properties that need work in country club communities. Usually the rehab work is more than the average buyer can handle and so it attracts builders who must pay the initiation fee but receive it back after the property has sold.

Many of the builder programs involve specific rules and requirements like the no one can live in the property or use the amenities, for example, while the property is under construction. Builder programs vary from community to community.

It’s a smart move because it’s better to market a 3 bedroom with a loft and a credit towards altering the loft than disappoint buyers who expect a 4th bedroom.

Ep. 69 - What’s Missing in the MLS With REF Expert Jill Glanzer

On today’s episode of Real Estate Finder, Staci Garcia and Jill Glanzer discuss some of their biggest pet peeves that have to do with Real Estate, and more specifically, the listing process on the MLS— Multiple Listing Service.

The MLS is a search engine that helps organize properties into searchable criteria. It is extremely useful and contains a lot of data. However, it is only as good as the agents using it. So if a listing agent doesn’t fill out the MLS properly, the system doesn’t work as well. Additionally, some people don’t fully understand how to fill out the options in the listing so the information is wrong and this leads to countless issues, namely that anyone searching for a property for example with one floor, will not find a ranch house or one-level property if the listing agent put anything other than one in the option for floor.

That’s just the tiny tip of the iceberg of a much larger problem because it’s not just incorrect information, but agents also skip certain sections probably thinking they aren’t important. If I search for a “Hamdyman” (property need a lot of work) and the agent doesn’t check the box for “Handyman,” then that property will not come up in a search.

This gets to be tenuous especially when a buyer wants a very specific property. So, we have investors who want original owner properties but there is no check box for original owner. Between Jill, Matthew and Staci, we can name 10 new criteria search boxes that don’t currently exist in the MLS.

To top that off, some real estate agents don’t even list the properties for sale. They are called “pocket listings” and those agents keep them “in their pocket presumably hoping to find their own buyers or potentially choosing which agents to tell that they prefer to work with.

So there’s a great deal of frustration that comes with incorrect data, incomplete data, no data and people not even using the MLS.

The MLS data is syndicated to all the other search engines like ZILLOW and Realtor.com and so on. So if the original data is wrong, incorrect or missing, it will be wrong, incorrect or missing all across the internet.

This leads to the scenario where a buyer is home searching on Zillow thinking they found something that they want and they hopefully tell their agent who looks up the property and says “I’m sorry Buyer, this is for age 55 or over only.” Or, “I’m sorry Buyer, this property is two stories and not just on the second floor.”

Then, buyer confidence in the agent might waiver because that agent doesn’t say what the buyer is looking at on their own computer screen. Now it gets tricky because Mr. Buyer starts to seek advice from additional real estate agents. And this is yet another pet peeve of most agents.

If one real estate agent is good, is two real estate agents better?? This part of the discussion is one that every agent should listen to and discuss with their buyer right from the start.

Welcome to the Real Estate Finder Podcast!

Matthew’s friend Elliot Edelman joins us. Elliot is a stock trader with almost 30 years of experience.

What is a stock trader? What is the difference between day trading and investing? We talk about all of this. Talk, we don’t answer. What is investing? It can mean different things for different people.

He’s taking his long acquired experience and sharing with the world his successful approaches to finances and investing. He is breaking into content creation through Tik Tok and LinkedIn and is amassing a huge following. Basically, he is becoming a social media influencer.

We talk about crypto, calculus and other controversial subjects. And learn from Elliot that his son Isaac is an aspiring sports broadcaster and writer who is the founder of FL Teams (flteams.com). (Maybe we can get him to cover Boca Raton Championship Wrestling?)

Matthew and Elliot meant a LONG time ago and have talked about finance, fatherhood and food for years and it was a pleasure to get this on the record. Matthew sold Elliot’s house in 2010. And still remembers much of what he learned on that deal. Buying and Selling real estate is different than buying and selling stock. We debate what it means to invest.

In talking about current events, we discuss a false story that happened at Disney World. I admit I fell for it. I believed a joke report about a tragedy on Space Mountain and am very embarrassed to discuss it on air as if it where true. Oh well, I made a mistake.

Other topics we discuss are education, discounting, marketing tips and tricks. And missing out on buying Bitcoin at $10. And $325. And $3,000. And $10,000.

Ep. 66 - How Realtors Get Paid and Let’s Talk Taxes

Who pays who in a real estate transaction?

The seller hires a real estate agent. They decide on how much of the Listing Agent’s commission will be offered to a Cooperating Agent (also called the Buyer’s Agent or the Selling Agent).

Who pays the Buyer’s Agent? The Seller’s Agent.

What if the Buyer uses more than one agent? The only agent for the buyer who gets paid is the agent who writes the offer.

Sounds simple but it gets mixed up by people all the time. Being a real estate agent is a commission based job. No one will pay you to be a tour guide. So we ask Buyers PLEASE be loyal to your agent!

Don’t click on the “For more information” button on a real estate website like Zillow or Redfin. Just send the address you see online to your real estate agent and give them a chance to do the work.

If you think the more agents who are looking for properties for you, the better chance you will find the right properties than you are inherently wasting the time of all the agents who don’t end up writing the offer. Only that one agent has the ball and could carry it to closing and get paid. Be loyal.

Residents of Boca Raton have been waiting patiently for some redevelopment at the site that was formerly Sears at Town Center at Boca Raton. The property is the most valuable piece of property in South Florida and it’s no secret that everyone has been hoping that a developer and the mall and the City of Boca Raton would come together with a project that would benefit the entire community.

What would you like to have at the property where Sears sits? We would definitely like to know! And, if you have any information on this development, let us know! The residents should be part of the decision-making process.

Ep. 65 - Happy New Year A/K/A Let’s get back to work!

On today’s episode of the Real Estate Finder Podcast, Matthew Maschler and Staci Garcia are joined by awesome Signature Real Estate Finder agent Jill Glanzer.

It’s a new year and a perfect time to adjust your sails and start fresh. We discuss several transactions we have been working on over the holidays. Real estate agents have no set hours and often work weekends and holiday because that’s the only time the buyer has available, or it’s convenient because the seller is away.

And if you have closings scheduled for early January, say good bye to your vacation time. It can be frustrating because you have some parties and businesses open and trying to work and finding an essential party or service is out of town. And bank holidays can make scheduling wire transfers difficult.

So plan ahead when you set your closings for mid-December 2023 and January 2024. Maybe we should make a rule: No closings scheduled for the first week of January :)

We also talk about being a good neighbor.

Do you know your neighbors? It makes daily life a completely different experience if you and your neighbors get along.

We have a closing this week in Whitehall. There are properties for sale in that building and also two condos for sale in Pompano Beach, first floor on the water, with adjoining doors if you have a best friend or relative who you want to live next door to. It’s a great idea for seniors who feel nervous about making new friends.

Ep. 64 - Furnished or Unfurnished?

On today’s Real Estate Finder Podcast, Matthew Maschler and and Jill Glanzer talk about what to do when the Buyer and Seller want to make a side deal for the furniture. Real property is land and anything built on it, or fixed to it. Personal property is the rest of your stuff. Televisions, Tables, Chairs, Art. Generally, the real estate contract covers the "real property." It can include some “personal property” but when there is a significant amount of “personal property” often a separate agreement can be made, and the price of that property would not be included in the contract price or the recording price. There are many reasons why a Buyer or Seller would want to keep the "personal property” separate and we discuss some of them. We also discuss ways to do it, whether it should be included on the closing statement and how to protect the customer.

A contract is a legally enforceable exchange of promises. When a Buyer makes an offer on a property, once signed by the Seller a Contract is formed. That Contract is legally enforceable. Ep. 61 - Bizarre Country Club Rules, Requests For Furniture and Required Addendums

On today’s Real Estate Finder Podcast, Matthew and Staci are joined once again by Jill Glanzer. We discuss a variety of real estate topics that came up this week, including bizarre country club rules, requests for furniture and required addendums.

It might not be happening as much as last year, but multiple offer situations still exist. When making an offer and time is a major factor, getting the offer to the listing agent quickly might take precedence over a few other things like an inventory list of included furniture.

Little known fact outside a country club: Not all golf carts are the same. Every country club has different rules regarding golf carts. Do your homework when showing or selling country club properties because these thing tend to come back later with fines and miscommunication costs money.

We are constantly asked about the state of the real estate market by both Buyers and Sellers. Supply and demand as always sets the market. The year ends with more supply and inventory is available. Yet, sellers aren’t lowering their prices as quickly as they did in cooler markets. Last year, buyers were all competing for limited properties to buy. This year, buyers have more options and can slow their roll, see a property more than once and ask questions.

Ep. 57 - It’s November and that means two things: Real Estate Taxes and Election Day

We talk about both. We also clarify the difference between the "Escrow Agent” and the "Closing Agent.” The only thing more confusing is that the Buyer’s Agent is also known as the Selling Agent! Matt also wants to address the Realtor’s role in the pre-closing Walkthrough.

On today’s episode, we discuss politics for about 25 minutes. Is that 25 minutes too much? If you’re voting in Palm Beach County, Florida, take a seat and tune in. If you’re voting elsewhere, you might find our chat interesting. If you don’t vote, what’s wrong with you!?

There’s a few words and terms in real estate that often trip up agents. We start with the difference between the Escrow agent on the offer and the Closing Agent. Please listen to the differences and make sure your offers reflect the appropriate escrow agent.

Another confusion term is Selling Agent. The Selling Agent is the Buyer’s Agent who sold the property to the buyer. The Listing Agent lists the property for sale and represents the Seller.

The Walkthrough is a time when the buyer makes sure the property is how it was when they last saw it, it’s not a time for negotiation.

Selling an income property is a lot different than selling your primary residence. You should treat it like a business. What’s the cap rate? How much income are you giving up?

If you want the tax deferral, consider the 1031 Exchange. Matthew explains the pros and cons of this method and why it was established in the first place.

A big and popular over-age 55 community in Florida is called The Villages. Steve is about to begin the search for a property there and it’s a bit different than most other places in Florida. They have their own MLS.

Ep. 51 - The Inspection Report, Definitions of Offer and Contract, If Something Is Too Good To Be True, It Probably Is.

You are the buyer and you pay for and get a real estate inspection on a property you want to buy. Then what? The inspection can be a time to get out of the contract because of something the inspector found. Or they can get out for any reason whatsoever. (It doesn’t have to do with the actual inspection results.)

If the buyer loves the house, they can ask the seller for a credit. If the seller gives them the credit, they move forward with the transaction.

Definitions of contracts and offers:

A contract is a legally binding contract.

An offer is a bid for the property.

Acceptance of the offer.

Consideration of the offer.

Offer in writing.

The seller’s listing is an invitation to make an offer.

The seller can counter an offer.

You’re the real estate buyer and your offer was accepted by the seller. Now what?

1. The First Deposit

2. Schedule Inspection.

3. Make Second Deposit the day AFTER Inspection.

4. If necessary, ask for credit, not repair.

5. If financing applies, order the appraisal.

6. Make sure one of the parties to the transaction has opened a file with the company doing the title.

7. Get movers.

8. The walkthrough.

9. Talk to seller or seller’s agent about gate access on closing day.

10. Initiate utilities including the HOA payments and any club membership.

Ep. 42 - The Real Estate Transaction With Jill Glanzer Part Three: The Buyer’s Side

You’re the buyer and you are looking for real estate in Florida. What do you need to know and what to tell your real estate agent? And if you’re the agent, what do you ask your buyer?

Do you want to be near an airport? What is your price point? Are you okay with (and can you afford) a home owner’s association (HOA) or a condo association? Do you want to be east or west? This is a question you will be asked often. Everything in Florida is east or west because we are surrounded by water. Are you an east coast of Florida person or a west coast of Florida person? Do you know the difference?

Buyers are never bothering us! Our job (and we love it!) is to show you properties. New construction, open houses, nothing is too big or too small and we will never say no. Bottom line: You’re never bothering us.

Once you find your ideal property, we write the offer. (Note: You should already know how you’re paying for the property so have your financing lined up BEFORE you contact us.) If the offer is accepted, we schedule the inspection and you should go to it.

Ep. 41 - Part 2 of the Seller’s Side of the Real Estate Transaction

As a continuation to the seller’s side of the real estate transaction, we pick up from last week with this question:

As a seller, have you ever received an offer and accepted it?

This is an interesting question because accepting an offer might seem very simple, but it’s quite a complicated situation. Accept the offer? Think maybe as a seller your price is too low? Wait for a better offer, even if this amount is what you wanted, or more? Counter the offer? Negotiate on the phone or in writing?

You counter or sign the offer. If you sign the offer, it’s now called a contract. If you counter with changes, it starts over again like a volley and goes back to the buyer for them to accept your changes or not, or to make additional changes.

Once you have a contract, you go through inspection period where the buyer can get out for any reason. This is sometimes seen as a negotiating period where a buyer will try to renegotiate the price based upon what the inspection says.

There’s lots of the things that could “go wrong” as the transaction goes from contract to closed. Aside from all of the title and financing moving parts, what does the seller have to do? There’s the walk-through. Do you have to have the property professionally cleaned? Or deep-cleaned? What does this mean?
